Terms of Service & Community Rules

1. About ColorShare

ColorShare is a community platform for coloring and craft enthusiasts, operated by BeaconAI LLC. Available as a mobile app (iOS and Android) and at colorshare.app.

2. Eligibility

• You must be at least 18 years of age to use ColorShare — you must confirm you are 18 or older during account creation
• ColorShare will terminate any account later discovered to have misrepresented its age at signup

3. Account Registration

• Sign in using Apple Sign-In or Google Sign-In only — no email/password accounts
• Create a unique username during onboarding. Usernames are subject to review and approval.
• Usernames must not contain vulgar, offensive, or hateful language
• You may not create multiple accounts to evade a suspension or ban — duplicate accounts will be terminated
• Accounts are non-transferable

4. User Content

What You Can Post

• Photos of completed coloring book pages you have personally colored
• Photos of craft projects you have personally created
• Photos of your coloring or craft space and organization
• Discussion and reviews of coloring books
• Color swatch documentation of your coloring tools

Your License to BeaconAI

By posting content, you grant BeaconAI LLC a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your content within ColorShare and in marketing materials for ColorShare. You retain ownership. You may delete your content at any time.

Watermarking

All images uploaded to ColorShare are automatically watermarked with the ColorShare logo and your username. By uploading images, you consent to this watermarking.

5. Community Rules

ColorShare is a welcoming, positive community. These rules exist to keep it that way. Violations result in strikes against your account. Three strikes result in a permanent ban.

Remember: this is a community built on creativity and encouragement. Treat every member the way you want to be treated.

Bullying & Harassment — Zero Tolerance

ColorShare has a strict zero-tolerance policy for bullying and harassment, including:

• Personal attacks, insults, or targeted mockery directed at any user
• Threatening language or behavior of any kind
• Repeated unwanted contact with another user
• Coordinated harassment or encouraging others to attack a user
• Hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin

Bullying violations may result in an immediate account strike without prior warning. Severe cases may result in immediate permanent ban.

NSFW & Explicit Content — Strictly Prohibited

• Nudity, sexual content, or sexually suggestive imagery of any kind
• Graphic violence, gore, or disturbing imagery
• Any content that sexualizes or exploits minors — results in immediate permanent ban and referral to NCMEC

All uploaded images are automatically screened by Google Cloud Vision SafeSearch before posting. Images flagged as explicit or violent are automatically rejected.

Note: Crime-themed, dark, gothic, and horror-aesthetic coloring book art is permitted on ColorShare and is a celebrated part of our community. Such content should be tagged using the Mature Content system during upload. Moderators may apply a tag to untagged mature-themed posts. Tagging is not a violation and does not affect your account standing.

Additional Prohibited Conduct

• Spam: repetitive, promotional, or off-topic posts
• Impersonation: pretending to be another user, public figure, or ColorShare staff
• Copyright infringement: posting scans of blank coloring pages for others to print and use
• Code injection: attempting to input malicious code via any text field
• Platform manipulation: using bots or automated tools to inflate likes, followers, or engagement

Reporting System

ColorShare provides a Report User feature on user profile pages for reporting harassment, bullying, hate speech, impersonation, spam, or other violations of these Terms. Reports require screenshot evidence and a good-faith confirmation. Submitting false, misleading, or malicious reports is itself a violation of these Terms and may result in action against your account.

Block Feature

You may block any user from your account at any time. Blocked users cannot interact with your content or view your profile. Blocks can be managed in Settings.

6. The Strike System

Immediate permanent ban (no strike progression) applies to: CSAM, credible threats of violence, coordinated harassment campaigns, and repeated ban evasion.

Ban appeals: appeals@colorshare.app — reviewed within 7 business days. BeaconAI LLC’s decision on appeals is final.

7. Subscriptions & Payments

• Ad-Free subscription: $1.99/month or $15.99/year — removes advertisements
• Pro subscription: $4.99/month or $49.99/year — includes ad removal plus unlimited Gallery storage, a Pro badge, custom profile banner, and Gallery PDF export
• Processed by Apple App Store (iOS) or Google Play Store (Android)
• Subscriptions auto-renew unless cancelled at least 24 hours before renewal
• Refunds governed by Apple and Google’s refund policies — BeaconAI LLC does not process refunds directly
• BeaconAI LLC may change pricing with 30 days notice to existing subscribers

8. Amazon Affiliate Disclosure

ColorShare is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. As an Amazon Associate, BeaconAI LLC earns from qualifying purchases.

9. Intellectual Property

• The ColorShare name, logo, design, and software are the intellectual property of BeaconAI LLC
• You may not copy, reproduce, or distribute any part of the ColorShare platform without written permission
• User-generated content remains property of the creator, subject to the license in Section 4

10. DMCA Notice and Takedown

BeaconAI LLC respects the intellectual property rights of others and expects users of ColorShare to do the same. BeaconAI LLC has designated an agent to receive notifications of claimed copyright infringement under the Digital Millennium Copyright Act (DMCA), registered with the U.S. Copyright Office (Registration No. DMCA-1080295):

Filing a Notice of Claimed Infringement

If you believe content on ColorShare infringes your copyright, send a written notice to the above agent that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material claimed to be infringing, with information reasonably sufficient to allow us to locate it (e.g., a link or description of the specific post)
4. Your contact information, including your address, telephone number, and email address
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

Notices that do not substantially comply with these requirements may not receive a response. Upon receipt of a valid notice, BeaconAI LLC will remove or disable access to the identified material and notify the user who posted it.

Counter-Notification

If your content was removed as a result of a DMCA notice and you believe it was removed in error or misidentification, you may submit a counter-notification to the agent above that includes:

1. Your physical or electronic signature
2. Identification of the material that was removed and its location on ColorShare before removal
3. A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the United States, any district in which BeaconAI LLC may be found), and that you will accept service of process from the person who filed the original notice

Upon receipt of a valid counter-notification, BeaconAI LLC will forward it to the original complaining party. BeaconAI LLC will restore the removed material not less than 10, nor more than 14, business days after receiving the counter-notification, unless we first receive notice from the original complaining party that they have filed a court action seeking to restrain the user from the infringing activity.

Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), BeaconAI LLC will terminate, in appropriate circumstances, the accounts of users determined to be repeat infringers of the copyrights of others. This policy applies independently of the general strike system described in Section 6, and BeaconAI LLC reserves the right to terminate an account after a single instance of clear, substantiated copyright infringement in serious cases.

11. Disclaimers & Limitation of Liability

ColorShare is provided on an “as is” and “as available” basis. BeaconAI LLC does not guarantee uninterrupted access or that user-generated content is accurate or appropriate. To the maximum extent permitted by law, BeaconAI LLC shall not be liable for indirect, incidental, or consequential damages arising from your use of ColorShare.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Alabama, United States, where BeaconAI LLC is formally registered, without regard to conflict-of-law principles.

Informal Resolution First

Before filing any arbitration or lawsuit, you agree to first contact BeaconAI LLC at legal@colorshare.app and describe the dispute in reasonable detail. BeaconAI LLC will attempt to resolve the dispute informally. If it isn’t resolved within 60 days of that notice, either party may proceed to arbitration as described below.

Binding Arbitration

Except as provided below, any dispute arising out of or relating to these Terms or your use of ColorShare will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be conducted by a single arbitrator and, unless you and BeaconAI LLC agree otherwise, will take place in Alabama or remotely by video conference.

Class Action Waiver

You and BeaconAI LLC agree that any arbitration or proceeding will be conducted only on an individual basis, not as a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding.

Fees

Arbitration fees are governed by the AAA’s Consumer Arbitration Rules, which cap what a consumer must pay and require BeaconAI LLC to bear the remaining costs in most cases. BeaconAI LLC will not seek its own attorneys’ fees or costs in arbitration unless the arbitrator finds your claim frivolous.

Your Right to Opt Out

You may opt out of this arbitration agreement by sending written notice to legal@colorshare.app within 30 days of first creating your ColorShare account. If you opt out, disputes will instead be resolved in the state or federal courts located in Alabama, and this Class Action Waiver and Jury Trial Waiver will not apply to you.

Jury Trial Waiver

To the extent any dispute proceeds in court rather than arbitration, you and BeaconAI LLC each waive the right to a jury trial.

13. Changes, Termination & Contact

• We will notify users of significant changes at least 14 days before they take effect
• You may delete your account at any time in Settings
• BeaconAI LLC may suspend or terminate accounts for violations of these Terms
